01 Acceptance of Terms
By accessing or using the services provided by MKC Services ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms").
These Terms constitute a legally binding agreement between you and MKC Services. If you are entering into this agreement on behalf of a business or organization, you represent that you have the authority to bind such entity to these Terms.
02 Our Services
MKC Services provides professional digital solutions including but not limited to:
Web Development
Custom websites, e-commerce platforms, web applications
App Development
iOS, Android, and cross-platform mobile applications
AI Solutions
Machine learning, automation, and intelligent systems
SEO & Marketing
Search optimization, digital marketing, brand growth
The specific scope, deliverables, timeline, and costs for each project will be outlined in a separate proposal or contract document.
03 Client Responsibilities
To ensure successful project delivery, clients agree to:
- Provide Accurate Information: Supply all necessary content, assets, and specifications in a timely manner
- Timely Feedback: Review deliverables and provide feedback within agreed timelines
- Designate Contact Person: Appoint a single point of contact for project communication
- Legal Compliance: Ensure all provided content complies with applicable laws and does not infringe third-party rights
- Payment Obligations: Make payments according to the agreed schedule
04 Intellectual Property
Client-Owned Work
Upon full payment, clients receive ownership of custom code, designs, and content created specifically for their project, excluding third-party components and our proprietary tools.
MKC-Owned Assets
We retain ownership of our development frameworks, libraries, templates, and tools used in project creation. Clients receive a license to use these as part of their deliverables.
Third-Party Elements
Third-party software, plugins, fonts, and stock assets are subject to their respective licenses. We will inform you of any third-party components used.
05 Payment Terms
Initial Deposit
50% advance payment required before project commencement
Milestone Payments
Additional payments may be due at project milestones as agreed
Final Payment
Remaining balance due before final delivery and source files handover
Payment Policies
- All prices are quoted in Indian Rupees (INR) unless stated otherwise
- Payments accepted via bank transfer, UPI, or other agreed methods
- GST (18%) will be applicable as per Indian tax regulations
- Late payments may incur additional charges and project delays
06 Warranty & Limitation of Liability
Warranty Period
We provide a 30-day warranty period from project delivery for bug fixes related to the original scope. This covers functional issues but excludes new feature requests or changes to requirements.
Limitation of Liability
- Our total liability is limited to the amount paid for the specific service
- We are not liable for indirect, consequential, or incidental damages
- We do not guarantee specific business results, traffic, or revenue outcomes
- Third-party service failures are beyond our control and liability
07 Termination
Either party may terminate the agreement under the following conditions:
Client Termination
You may terminate by providing written notice. Payments made for completed work are non-refundable. Work in progress will be billed proportionally.
MKC Termination
We may terminate if payment obligations are not met, required materials are not provided, or continued work becomes commercially impractical.
Upon termination, we will deliver all completed work for which payment has been received. Source files and proprietary materials are released only after full payment settlement.
08 Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
Negotiation: Parties will first attempt to resolve disputes through good-faith negotiation
Mediation: If negotiation fails, parties may opt for mediation
Arbitration/Litigation: Unresolved disputes may proceed to arbitration or court
